Data Product License
This Data Product License governs access to datasets, reports, APIs, feeds, MCP tools, and related documentation supplied by Elkwai Solutions, LLC (“Elkwai”). It applies together with the Elkwai Data Service Terms and Data Privacy Notice. If an order, statement of work, or enterprise agreement contains more specific terms, those terms control for that order.
1. License grant
For the subscription period and scope shown in the applicable order, Elkwai grants the subscribing customer a limited, non-exclusive, non-transferable license to access and use the delivered data and derived outputs for the customer’s internal business, research, analysis, and decision-support purposes.
2. Permitted use
- Use the data within the authorized customer organization and approved systems.
- Make reasonable internal copies needed for backup, analysis, and business continuity.
- Use derived analysis internally when the source, version, timestamp, and applicable limitations remain traceable.
- Share results with the customer’s professional advisers and contractors who are bound by confidentiality and use limits at least as protective as this license.
3. Restrictions
Unless Elkwai gives written permission, the customer must not resell, publish, sublicense, redistribute, mirror, scrape, bulk-download for third parties, expose credentials, or use the service to build a substantially substitutable public dataset or service. The customer must not attempt to re-identify individuals or combine the service with other information to create a prohibited personal profile.
4. Source rights and attribution
Elkwai preserves source identifiers, timestamps, licenses, attribution requirements, and access restrictions in its internal records. A customer receives only the rights that Elkwai is permitted to grant. Source-specific terms, attribution requirements, and redistribution limits pass through to the customer where identified in the order or delivery documentation. Raw source documents are not licensed for redistribution merely because they are referenced by an Elkwai output.
5. Accuracy and decision responsibility
Data and derived outputs may be incomplete, delayed, changed by the source, or subject to interpretation. They are decision-support materials, not a substitute for professional review, primary-source verification, legal or regulatory advice, investment advice, or a required operational control. The customer remains responsible for its decisions, notices, compliance obligations, and human review.
6. Security and access
Customers must protect credentials, use only authorized accounts and endpoints, promptly report suspected compromise, and avoid placing secrets or unnecessary personal information in API requests. Elkwai may rate-limit, suspend, or revoke access when needed to protect the service, comply with a source restriction, investigate abuse, or prevent unauthorized disclosure.
7. Customer data
Customer-submitted data remains subject to the order, the Data Service Terms, and the Data Privacy Notice. Customers must have the rights and permissions needed to submit that data. Elkwai does not require payment-card numbers or secret credentials in ordinary data-product requests.
8. Termination
When the subscription or license ends, the customer must stop accessing the service and stop new use of licensed outputs, except for archival copies retained under a documented legal or business-continuity requirement. Confidentiality, source-rights, security, payment, and limitation provisions continue as applicable.
9. Contact
